Art Form Pilates Studio Terms and Conditions
By signing up to participate in our classes, you agree to be bound by our Terms and Conditions set out below.
If you do not agree with any of these Terms and Conditions, please do not participate in our classes.
We reserve the right to change, update or reissue these Terms and Conditions at any time. Any such changes will be posted to our Website and you agree to be bound by such changes.
References to “we”, “us” and/or “our” in these Terms and Conditions is a reference to Art Form Pilates and its’ related entities.
You acknowledge that your participation in any from or exercise at our studio may involve risks, including risk of personal injury. Prior to undertaking any new form of exercise, you should consult with your doctor or other healthcare practitioner to ensure that you are mindful of your current health and any restrictions that may be appropriate for you.
You must inform instructors if there are any risks to your health by participating in Pilates, including in a Class, such as if you have a pre-existing injury, illness, muscle soreness/discomfort or are pregnant, prior to commencement. Participating in any form of exercise at our studio with a Medical Condition is done entirely at your own risk.
By undertaking any exercise program, you acknowledge that you do so at your own risk and that the owners, creators, producers, instructors and distributors of our exercise programs, together with the agents or insurers will not be liable for any personal injury, loss or liability of whatsoever nature arising as a result of, or in connection with, your undertaking of any such exercise program or following advice contained on our website or given by our instructors.
By participating in our classes, you agree that our liability in relation to recreational services (as that term is defined in section 139A of the Competition and Consumer Act 2010 (Cth)) for any death, physical or mental injury (including aggravation, acceleration or recurrence of any such injury), the contraction, aggravation or acceleration of a disease, the coming into existence, aggravation, acceleration or recurrence of any other condition, circumstance, occurrence, activity, form of behaviour, course of conduct or state of affairs that is or may be harmful or disadvantageous to you or the community, or that may result in harm or disadvantage to you or the community, that may be suffered by you as a result of the supply of recreational services by Art Form Pilates is hereby excluded, save that this limitation of liability does not apply to significant personal injury suffered by you as a result of reckless conduct by Art Form Pilates in supplying the recreational services.
Our current prices and timetables are displayed on our Website. From time to time, our prices may change and these will be notified on the Website.
There are a set number of spaces in each class. To attend a class, you must reserve a space. Bookings can be made by calling or emailing our studio.
We require payment at the time of purchasing a session or class pack. Payment can be made in person at reception, over the phone with a credit card (Mastercard or VISA) or by direct transfer into our nominated bank account.
Payment over the phone must be done between business hours from 8am to 6:30pm. If you are booked in for a 7:30pm class, you are required to pay in advance of your session or during these hours over the phone to ensure your spot is reserved for you.
All classes must be pre-paid before attending. A class pack entitles the holder of the pack attendance at classes offered. There are a set number of spaces in each class. To attend a class, you must reserve a space. You are encouraged to book the dates and times of the classes or sessions that you wish to attend for the number of sessions purchased in your pack.
Each class pack contains a strict expiry date. If the number of classes for which the class pack entitles attendance have not been used by the holder before the expiry date, then those classes will expire and no refund will be given for any unused classes. Current prices and expiry time frames for each type of class pack can be found on our website and may be amended from time to time.
Class packs are non-transferrable between holders, and may not be sold, traded, gifted, shared, provided or otherwise transferred to any person other than the purchaser.
The sale of a class pack is final. Art Form Pilates agrees to reserve the dates and times agreed upon, and not accept any additional clients, besides the maximum number of clients for each class, for the reserved dates and times agreed upon during your pack. For this reason, Art Form Pilates does not offer any refunds, transfers, suspensions or extensions on class packs for change of mind, user error, change of address, unsuitability or any other reason in order to offset its loss of business. In the case of injury or illness, Artform Pilates must be notified in writing and a medical certificate will be requested. Extensions due to medical reasons must be requested before the expiry date.
Class Schedules are subject to change or cancellation without notice. Art Form Pilates reserves the right to cancel classes if necessary. If Art Form Pilates cancels your class, you will be entitled to an additional week for your pack.
We are not liable in any way to provide you with a refund, credit, transfer or compensation of any kind for classes that are not held in accordance with the class schedule, including without limitation any classes that are changed or cancelled.
If you have not booked into a class, in order to avoid disappointment, please call to check that the classes are taking place, particularly in the early morning and late evening.
Should you miss a class during the course, make up classes will be accommodated where and if possible, within the current course. If we cannot accommodate a catch-up class at a mutually convenient time, you will lose the session. Any classes that are not caught up during the course will not be refunded.
If you know you are going to miss a class, you are welcome to do a make up sessions before expiry of your pack. We prefer that you try and organise your catch-up session before you are absent or within a week of returning from being absent.
Our regular reformer classes are safe for women to attend up to 14 weeks of pregnancy. Once pregnancy reaches 14 weeks, it is required that you stop attending the standard classes. Alternatively, please seek permission from your obstetrician/gynaecologist if they are happy for you to continue reformer classes.
Special pregnancy classes are offered. These classes are safe for women to attend throughout their entire pregnancy up to full term, if they feel comfortable to do so. Please call our studio to check for availability.
If you are unable to book a spot because the class is full, register yourself on the waitlist by calling or emailing our Studio and when a spot becomes available, you will be notified whether you would like to be automatically booked into the workout.
Cancelation shall include, but is not limited to: the postponement, delay or rebooking of the class to another day.
To cancel a booking, you must notify Art Form Pilates reception at least 12 hours prior to the commencement of the class. To cancel your booking, you must call reception on 9587 9130 to reschedule your booking. Please do not contact our instructors directly.
This will allow the clients we have on our waitlists to come in, with enough notice. Cancellations made with less than 12 hours’ notice will incur the full cost of the class booked. Class bookings can be cancelled by calling or emailing our Studio. Sessions may be frozen due to medical reasons (on receipt of a written letter from a doctor).
If you know you will not be able to make a class for which you have booked, within the 12-hour cancellation window, we strongly encourage a cancellation to be made, so that another person may take your reservation on the reformer.
Artform Pilates and its affiliated entities, reserves the right to refuse entry to, or eject from our studio, clients or others who are behaving in an anti-social, intoxicated, disorderly, aggressive, offensive or dangerous manner or in any manner which may threaten the security of our clients or other people attending our studio.
In order to minimise disruption during classes held, we recommend that you aim to arrive at least 5 minutes prior to the scheduled commencement time of a Class. Clients are strongly discouraged from departing classes prior to their scheduled conclusion time as it is disruptive to the enjoyment of others attending those classes.
Art Form Pilates is not responsible in any way for the safekeeping of your personal belongings that you bring into our Studios. As such, we strongly recommend that you bring only any personal belongings into our Studios which are absolutely necessary for you to possess for the duration of your visit.
Except for any liability that cannot be excluded by law, Art Form Pilates (including its officers, employees and agents) excludes all liability (whether under the law of contract, tort or otherwise), for any personal injury, loss or damage (including but not limited to loss of opportunity, loss of reputation or goodwill, loss of privacy or loss or corruption of information or data); whether direct, indirect, special or consequential, arising in any way out of your attendance at our classes. This includes but is not limited to any theft, unauthorised access or third-party interference.
This limitation of liability applies even if Art Form Pilates has been expressly advised of potential loss.
These Terms and Conditions are governed by the law in force in New South Wales, Australia. You irrevocably submit to the non-exclusive jurisdiction of the courts exercising jurisdiction in New South Wales, and any court that may hear appeals from any of those courts for any proceeding in connection with these Terms and Conditions.
